The Terms and Conditions below apply to all activities of Kring Vrienden van ‘s-Hertogenbosch and tickets reserved on DagjeDenBosch.com and MuseumKruithuis.nl.

Article 1 Definitions

1. In these terms and conditions, the following definitions apply:

a) De Kring: the association ‘Kring Vrienden van ’s-Hertogenbosch’ and all foundations and organizations associated with De Kring.
b) The terms and conditions: the general participant conditions of De Kring.
c) Participant: any person or legal entity that in any way, directly or indirectly, enters into an agreement with De Kring regarding attending an event to be organized by De Kring.
d) Proof of participation: proof of participation in activities organized by De Kring, which in some cases also includes the admission ticket for entry to various cultural-historical sites or buildings.
e) Activities: all cultural activities organized by De Kring, which include but are not limited to:

Article 2 Applicability

2.1 These terms and conditions apply to all activities and agreements relating to activities of De Kring and tickets reserved on DagjeDenBosch.com and MuseumKruithuis.nl, and to all actions to be performed for the execution of the relevant agreement, unless these terms are explicitly deviated from in writing prior to the conclusion of the agreement.

2.2 The applicability of the terms and conditions does not affect the possible applicability of other (contractual) conditions and/or regulations of De Kring.

2.3 The applicability of general terms and conditions of third parties, including the participant, is explicitly rejected by De Kring. These terms and conditions always take precedence and are therefore exclusively applicable to all agreements concluded by it.

2.4 In the interpretation of these terms and conditions, the Dutch language prevails, even if they have been translated into another language.

Article 3 Quotes and Offers

3.1 Every quote or offer from De Kring is merely a non-binding invitation to the participant to enter into an agreement with De Kring; no rights can be derived from the quote or offer in any way if the product to which the quote or offer relates is no longer available in the meantime.

3.2 De Kring cannot be held to its quotes or offers if the participant can reasonably understand that the quotes or offers, or a part thereof, contain an obvious mistake or clerical error.

Article 4 Conclusion of the Agreement

4.1 The agreement is concluded exclusively when De Kring and the participant have accepted the terms of the agreement in writing (via email).

4.2 Confirmation of participation in an activity organized by De Kring is provided in writing. One can register for an activity by telephone, via the internet, or by email.

Article 5 Reservations and Payment

Individual (single tickets) 5.1 For reservations and single ticket sales for individual city walks, guided tours, boat tours, and museum visits, see DagjeDenBosch.com. Participants can reserve tickets up to 15 minutes before the start of the activity, unless otherwise indicated on the website. 5.2 When reserving tickets, the participant is immediately directed to the Pay.nl payment environment and pays for the desired tickets. 5.3 The participant’s credit card is charged immediately upon payment. 5.4 If the participant reserves by telephone, the participant will receive a payment request by email which must be paid within the period indicated therein. 5.5 If payment is not received on time, the reservation will lapse. The participant can then no longer claim the reservation. Any amounts received too late will be refunded. 5.6 All payments to De Kring are made without suspension or set-off. Groups 5.7 City walks for groups led by a guide are possible by appointment. 5.8 Guided tours of St. John’s Cathedral, St. John’s Tower, Zwanenbroedershuis, Town Hall, and Kruithuis Museum for groups led by a guide are possible as far as opening hours allow. 5.9 A maximum group size of 15 people applies to guided tours and city walks. 5.10 There is no minimum group size; the group rate remains unchanged. 5.11 A group reservation for guided tours and city walks can be made by telephone/email no later than 2 weeks before the desired date. 5.12 Boat tours for groups (private boats) are possible for the Historical route and the Kruithuis route in the evenings at 6:00 PM and 7:00 PM. The maximum group size is 14 people (Historical route) or 16 people (Kruithuis route). There is no minimum group size. 5.13 A group reservation for these boat tours can be made by telephone/email no later than 3 weeks before the desired date. 5.14 Packages (city walk/guided tour/boat tour with a catering component) are possible as far as opening hours and sailing schedules allow. 5.15 A package can be reserved by telephone/email with the reservation office no later than 4 weeks before the desired date. 5.16 The reservation is confirmed to the participant in writing with a confirmation. The total amount includes VAT and transaction costs. Payment for packages, boat tours, guided tours, and city walks must be in our possession no later than 14 days before the activity. 5.17 If payment is not received on time, the reservation will lapse. The participant can then no longer claim the reservation. Any amounts received too late will be refunded. 5.18 All payments to De Kring are made without suspension or set-off.

Article 6 Cancellation and Refund Policy

Individual (single tickets)

6.1 Tickets already paid for will not be taken back; there is no right to a refund. This also applies to unused tickets.

6.2 Tickets already paid for can be rebooked to another date or time up to a maximum of 72 hours before the activity (city walk, guided tour, boat tour, or museum visit).

6.3 If the participant does not yet have a new date in mind, there is a second option. The participant will receive a digital voucher for the amount paid (excluding transaction costs) which can be spent within 120 days of issue on all activities available on the desired new date.

6.4 Rebooking reserved tickets is only possible by telephone via the Parade 12 Desk. Accessibility times: Monday to Sunday 11:00 AM – 4:00 PM.

6.5 De Kring informs the participant that it makes no exceptions to the above provisions under any circumstances.

6.6 If De Kring proceeds with cancellation on its own initiative, the participant is entitled to a refund of the amount paid.

Groups and packages

Cancellation periods within which cancellation or rebooking, or modification of a group booking for city walks, guided tours, boat tours led by a (skipper) guide, as well as packages, is possible.

6.7 The participant can cancel the booking free of charge up to 15 days before the date of the group booking/package.

6.8 Changes to the reservation, such as a reduction in the number of groups or number of people per group or the catering part, are possible up to 15 days before the date of the group booking/package. After this, no refund is possible.

Cancellation of activity by De Kring

6.10 Guided tours in St. John’s Cathedral cannot take place if a funeral or other service is held at the time of the relevant tour. In this case, a refund of the amount paid by the participant will follow.

6.11 Guided tours in the Town Hall are subject to municipal activities. If this unexpectedly occurs, a refund of the amount paid by the participant will follow.

6.12 In case of cancellation of your activities (city walk, guided tour, boat tour, or museum visit) due to extreme weather conditions or other causes that endanger the safety of our guests: De Kring will then proceed with a refund of the amount paid to De Kring.

6.13 The refund will be processed by De Kring within 10 working days.

Article 7 Liability

7.1 Participation in activities organized by De Kring takes place entirely at your own risk and under your own responsibility.

7.2 De Kring is not liable for damage of any kind caused by De Kring acting on incorrect and/or incomplete data provided by or on behalf of the participant.

7.3 If the participant suffers damage in any way during or as a result of the activity/activities, De Kring cannot be held liable, unless this is due to intent or gross negligence on the part of De Kring.

7.4 The liability of De Kring is in any case always limited to the amount paid out by its insurer in the relevant case.

7.5 The total liability of De Kring due to an attributable shortcoming in the fulfillment of the agreement or on any legal ground whatsoever is limited to compensation for direct damage, up to a maximum of the amount paid out by its insurer in the relevant case, or if this is lower: the price stipulated for that agreement (excl. VAT).

7.6 The liability of De Kring for indirect damage is excluded.

Article 8 Complaints

8.1 Complaints regarding the activities organized by De Kring must be submitted in writing to De Kring within 5 days after the end of the activities or the program.

8.2 Submitting a complaint does not suspend the payment obligation of the invoice.

Article 9 Applicable Law and Competent Court

The agreement and any disputes arising from or related to it are governed by Dutch law. Any disputes will be submitted exclusively to the legally competent court in the Netherlands.
